This Privacy Notice explains how Pekochat collects, uses, discloses, and retains personal information for users in the United States. State-specific rights may apply depending on your state of residence and whether Pekochat meets legal thresholds.
1. Summary
Pekochat is an AI character chat and public story/community service. We process private chats to generate responses, maintain context, provide memory features, operate safety systems, investigate abuse, support users, process payments, and comply with law.
Public stories, public characters, public posts, public images, comments, and Shared Conversations are public by design and may be displayed, recommended, promoted, translated, adapted, and commercially used as described in the Terms.
2. Personal information we collect
Account and profile information
Email address, password hash, username, display name, profile image, date of birth or age confirmation, selected country/region, display language, account ID, settings, consent records, and communication preferences.
AI chat and character information
Private chat messages, AI responses, character settings, scenario settings, lorebooks, room settings, user notes, memory summaries, embeddings or similar retrieval values, timestamps, token or usage counts, and related metadata.
Public content and community activity
Public characters, public stories, public prompts, public lorebooks, public posts, public images, Shared Conversations, comments, likes, follows, blocks, reports, moderation actions, and public profile information.
Payment and Peko information
Order IDs, Peko balances, wallet ledger entries, payment status, payment processor tokens or identifiers, refund history, chargeback history, billing country, tax-related information where applicable, and fraud-prevention signals. Full payment card numbers are handled by payment processors rather than by Pekochat’s ordinary service database.
Device, usage, log, and security information
IP addresses processed by infrastructure, pseudonymized IP-derived security identifiers, approximate network location when provided by infrastructure or security providers, browser, device, operating system, user agent, session identifiers, cookie identifiers, pages viewed, feature usage, errors, security logs, rate-limit data, API requests, and abuse-prevention signals.
Age or identity verification information
Where required for age, region, payment, legal, or safety controls, we may process age-check result, verification timestamp, provider reference ID, country or state result, and verification status. We try to avoid storing government ID images or raw identity numbers unless necessary and disclosed.
Support and legal communications
Messages you send to support, reports, appeals, takedown requests, legal requests, and related records.
3. How we use personal information
We use personal information to:
- create and manage accounts;
- provide AI chat, memory, character, story, Shared Conversation, and community features;
- generate AI responses and maintain conversation context;
- process Peko purchases, refunds, fraud checks, and accounting;
- provide age, region, payment, legal, and safety access controls;
- respond to support requests, reports, appeals, and disputes;
- moderate content and enforce our Terms and policies;
- detect abuse, bots, scraping, fraud, security incidents, and unlawful activity;
- debug, audit, maintain, and improve service reliability and safety;
- comply with law, legal process, tax, accounting, and regulatory obligations;
- send service notices, security alerts, and policy updates;
- send marketing communications if you opt in or as otherwise permitted, with opt-out options.
4. AI chat and User Content processing
Pekochat processes AI chat data and User Content for the purposes listed in this Notice, including response generation, conversation context, user-facing memory, safety systems, moderation, debugging, abuse prevention, security, support, legal compliance, chargebacks, and dispute handling.
Public Content is handled under the Terms and may be used for display, recommendation, curation, promotion, translation, adaptation, merchandise, derivative works, and commercialization.
We may use aggregated or anonymized information that does not identify you to understand usage, performance, safety trends, service costs, and aggregate safety-protocol metrics.
5. Human/admin access to chats
Administrator review is purpose-based and selective. Authorized personnel or contractors may access private chats, AI outputs, account information, reports, metadata, or logs when reasonably necessary for:
- user support requested by you;
- safety, abuse, self-harm, exploitation, or illegal-content review;
- debugging, outage, and reliability investigation;
- payment disputes, refunds, fraud, or chargebacks;
- Terms enforcement and moderation appeals;
- legal compliance, legal claims, or valid legal requests.
Admin access is limited to authorized personnel or contractors with a legitimate operational need and is subject to role-based access, reason-code logging, multi-factor authentication where appropriate, and audit logs. Safety controls, when used, are operational tools and do not create a guarantee that all harmful content or outcomes will be detected or prevented.
6. Sensitive information
Pekochat primarily processes account, chat, content, payment, security, and support information for the purposes described in this Notice. Because Pekochat is a roleplay and character-chat service, you may voluntarily include sensitive information such as health information, precise sexual orientation, religious beliefs, political opinions, government identifiers, or biometric data in chats, stories, reports, or support messages.
If you include sensitive information, we process it only for the purposes described in this Notice, including providing the requested chat or feature, safety, support, legal compliance, and dispute handling. Avoid submitting real-world sensitive information unless necessary.
7. How we disclose information
We may disclose personal information to:
- AI providers that generate responses, summaries, embeddings, or related computations;
- cloud hosting, database, storage, CDN, security, and logging providers;
- payment processors, tax, accounting, and fraud-prevention providers;
- age or identity verification providers;
- customer support and communications providers;
- analytics providers, subject to applicable consent and opt-out rights;
- professional advisers, insurers, auditors, and legal representatives;
- law enforcement, regulators, courts, or others when required or permitted by law;
- a buyer, investor, successor, or affiliate in a merger, financing, restructuring, or asset transfer;
- the public and other users, when you publish Public Content or Shared Conversations.
Our disclosures of Private Chats are for the operational purposes described in this Notice, such as AI response generation, support, safety, security, legal compliance, and disputes. If applicable state privacy laws treat some advertising or analytics disclosures as “sale,” “sharing,” or “targeted advertising,” you may have opt-out rights.
8. Third-party AI providers
To generate AI responses, we may send the current message, relevant conversation context, character settings, memory summaries, user notes, safety context, and related metadata to AI providers such as OpenAI, Anthropic, Google, and other configured AI providers. Some providers may temporarily retain API data for abuse monitoring, security, or legal compliance under their own business/API terms. Pekochat’s vendor list or Privacy Center, if published, describes provider retention, data-control settings, and processing terms.
9. Cookies and tracking
We use cookies and similar technologies for login, security, preferences, analytics, performance, and, if enabled, advertising or measurement. You can control cookies through browser settings and, where applicable, through our cookie or privacy preference tools.
10. Retention
We retain information as long as reasonably necessary for the purposes described above, including providing the Service, maintaining accounts, resolving disputes, enforcing Terms, complying with law, and maintaining security.
Private chats are retained until you delete them, delete your account, or the applicable retention period ends, unless longer retention is needed for safety, legal, abuse, payment, backup, or dispute purposes.
Public Content may remain available until you delete or unpublish it, subject to the Terms. Backups and logs may persist for a limited period. Payment, tax, fraud, and legal records may be retained longer.
11. Your choices
Depending on your state and our legal status, you may request access, correction, deletion, portability, opt-out of sale/sharing/targeted advertising, limitation of sensitive information use, or appeal of a privacy decision. Submit requests to [email protected] or through /account.
You may delete certain chats, content, or your account through available tools. Some information may remain where retention is required or permitted.
You may opt out of marketing emails by using the unsubscribe link or contacting us.
12. California notice
If the California Consumer Privacy Act applies to Pekochat, California residents may have rights to know, access, delete, correct, opt out of sale or sharing, limit use of sensitive personal information, and non-discrimination. Pekochat will provide a “Do Not Sell or Share My Personal Information” or equivalent mechanism if required.
Categories collected may include identifiers, account information, commercial information, internet or electronic network activity, approximate geolocation, user-generated content, sensitive personal information voluntarily submitted by users, inferences, and payment-related records.
13. Children and teens
Pekochat is for users 18+. Accounts that appear to belong to underage users may be suspended or deleted.
14. Security
We use administrative, technical, and organizational safeguards designed to protect personal information, such as access controls, encryption in transit, password hashing, logging, rate limits, and security monitoring. No system is perfectly secure.
15. International processing
Personal information may be processed in the United States and other countries where we or our service providers operate. Those countries may have different data protection laws.
16. Changes
We may update this Privacy Notice. Material changes will be posted or otherwise notified. If required by law, we will seek consent.
