1. Who may use Pekochat

1. Pekochat is offered to users who are 18 years of age or older, unless we make a separate eligibility flow available for a specific region or product.
2. If we identify an account that does not meet the applicable minimum-age or eligibility requirements, we may restrict the account and process related information as required or permitted by law.
3. You must provide truthful account, age, billing, and country/region information. We are not required to independently investigate every user’s residence, but we may require re-confirmation, deny payment, restrict features, suspend access, or terminate an account if we reasonably identify a material mismatch among selected country/region, billing country, account eligibility information, or other non-IP account or payment signals.
4. Accounts located in, ordinarily resident in, or subject to sanctions or restrictions that prohibit use of the Service may be rejected, restricted, or terminated.

2. The Service

Pekochat provides online services including AI character conversations, character and story creation, public story and shared conversation features, comments, likes, follows, blocking, reporting, image uploads, paid virtual credits called Peko, and related functions.

We may change, suspend, limit, or discontinue any part of the Service at any time, including AI models, characters, features, prices, Peko packages, usage limits, content categories, or safety controls. We will try to provide reasonable notice for material changes, but we may act immediately for security, legal, abuse-prevention, or operational reasons.

3. Account security

You are responsible for your account credentials and activity under your account. Do not sell, transfer, rent, share, or sublicense your account. Notify us promptly if you suspect unauthorized access.

4. AI character notice

1. Pekochat characters are AI-generated or AI-assisted systems. They are not real people, licensed professionals, therapists, doctors, lawyers, financial advisers, emergency responders, or fiduciaries.
2. AI responses may be fictional, inaccurate, incomplete, offensive, unsafe, repetitive, or similar to responses generated for other users.
3. Do not rely on Pekochat for medical, mental-health, legal, financial, safety, emergency, or other high-stakes decisions.
4. We may display AI notices in chat screens, character profiles, onboarding, long sessions, and other places. You may not remove, obscure, or misrepresent those notices.

5. No emergency service; crisis and self-harm safety

Pekochat is not an emergency or crisis-response service. If you or someone else may be in immediate danger, contact emergency services in your area. In the United States, you can call or text 988 for the Suicide & Crisis Lifeline.

We may use automated and manual safety tools to detect or respond to self-harm, suicide, threats of violence, exploitation, or similar risks. We do not guarantee that these tools will detect every risk or prevent every harmful output. We may interrupt conversations, display crisis resources, block outputs, restrict accounts, preserve information, or report to appropriate channels where legally permitted or required.

Where applicable law requires AI companion safeguards, Pekochat may provide upfront AI notices, continuing-session reminders, break reminders, public safety-protocol summaries, and aggregate safety reports. These safeguards are product controls and operational measures, not a guarantee that every risk will be detected or prevented.

6. Processing User Content to operate the Service

1. Pekochat may process User Content, AI Output, account information, metadata, logs, payment records, and related information for the purposes described in these Terms and the Privacy Notice.
2. Those purposes include providing AI responses, maintaining the conversation context requested by you, producing user-facing memory summaries or embeddings, operating safety systems, debugging, support, security, fraud prevention, chargeback handling, legal compliance, policy enforcement, and dispute resolution.
3. Third-party AI providers may process prompts, context, settings, outputs, safety context, and related metadata to generate responses, summaries, embeddings, or related computations. Provider retention, abuse-monitoring, and data-control practices are described in the Privacy Notice or vendor list.
4. Public Content and Shared Conversations may be displayed, recommended, ranked, translated, promoted, adapted, commercialized, and otherwise used as described in the public-content sections below.

7. User content categories

For these Terms:

1. Private Content means private chats, private room settings, private notes, private memory summaries, private images, or other materials not intentionally made public by you.
2. Public Content means content you intentionally publish, list, share, submit to public areas, or make available to other users, including public characters, public stories, public posts, comments, public images, public lorebooks, public prompts, and Shared Conversations.
3. Commercializable Public Content means Public Content that is primarily creative or narrative and that you intentionally publish through a story, character, lorebook, prompt, image, Shared Conversation, collection, or other publish flow that identifies the content as public creative content. Ordinary comments, likes, follows, blocks, reports, support messages, account metadata, and routine community interactions are not Commercializable Public Content unless you separately publish them as part of a creative public work or agree otherwise.
4. Shared Conversations means a chat or excerpt that you choose to publish, serialize, embed, link, or otherwise make available to other users or the public. Once published, a Shared Conversation is Public Content and may be Commercializable Public Content if the publish flow identifies it as such.
5. AI Output means text, images, voice, video, character replies, summaries, suggestions, or other outputs generated or assisted by AI through the Service.

8. Your ownership and responsibility

1. You keep whatever rights you have in your User Content.
2. You are responsible for your User Content and for ensuring that you have the rights needed to submit, publish, share, or monetize it.
3. You must not upload or publish content that violates law, infringes rights, invades privacy, contains illegal sexual content, sexualizes minors, promotes self-harm or violence, impersonates others deceptively, contains malware, or violates our policies.
4. AI Output may not be protected by copyright in some jurisdictions, may be similar to output generated for others, and may be subject to third-party rights or underlying content rights. You are responsible for reviewing AI Output before using, publishing, or commercializing it.

9. License for operating the Service

For all User Content, including Private Content, you grant Pekochat a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, transmit, display to you, format, translate as needed for the Service, analyze, and otherwise use the content solely to:

1. provide, maintain, secure, and improve Service reliability, safety, usability, and functionality;
2. generate AI responses and maintain your requested conversation context;
3. process payments, support requests, reports, disputes, and legal obligations;
4. prevent abuse, enforce these Terms, and protect users, the public, and Pekochat; and
5. perform backup, audit, logging, debugging, and service-integrity functions.

10. Commercializable Public Content license

When you intentionally publish Commercializable Public Content, you grant Pekochat a broader license in that Commercializable Public Content. Shared Conversations and other sensitive publish flows require a separate publish action or confirmation screen.

That license is non-exclusive, worldwide, royalty-free, transferable, sublicensable, and allows Pekochat to use, host, reproduce, display, distribute, publicly perform, publicly display, translate, edit for format or length, create derivative works from, adapt, promote, merchandise, commercialize, include in collections, publish in online or offline media, and sell products or services based on or incorporating that Commercializable Public Content.

This means, for example, Pekochat may use Commercializable Public Content or elements of it in featured story pages, recommendation feeds, promotional videos, character collections, translations, anthologies, printed goods, digital goods, game-like experiences, merchandise, licensing deals, or other commercial projects.

Ordinary comments, likes, follows, blocks, reports, support messages, account metadata, and routine community interactions may be hosted, displayed, moderated, preserved, removed, or used to operate and protect the Service. A standalone merchandise, offline publishing, external licensing, or unrelated derivative commercial-project license applies to those materials only when you separately publish them as part of a creative public work or agree otherwise.

You may also use and monetize your own Commercializable Public Content independently, subject to these Terms, third-party rights, other users’ rights, and Pekochat’s rights in the Service, brand, software, characters, tools, and platform elements.

Unless we separately agree in writing, Pekochat has no obligation to pay revenue share, royalties, attribution, approval rights, accounting, or compensation for uses authorized by this license. If Pekochat offers a creator program, marketplace, or revenue-share program, separate terms will apply.

If you delete or unpublish Commercializable Public Content, ordinary public availability through the Service is handled under the applicable deletion or unpublishing tools and timing. The license remains effective for: uses already made; derivative works or merchandise already created or in production; sublicenses already granted; backups; legal preservation; moderation records; safety records; and reasonable archival, accounting, or dispute purposes. To the extent permitted by law, you agree not to assert moral rights or similar rights against Pekochat or its sublicensees for uses authorized by this section.

11. Public characters and downstream creations

If you publish a character, story, lorebook, prompt, scenario, or setting as Public Content, you authorize other users to interact with it through Pekochat and to generate AI Output from that interaction. When downstream chats, outputs, remixes, or Shared Conversations are intentionally published through a public or commercializable publish flow, Pekochat may display, promote, and commercialize those published downstream materials as described above.

If you publish a Shared Conversation involving another user’s public character or public story, your rights are subject to the original creator’s rights, Pekochat’s rights, and these Terms. You may not publish private content from another human user without permission.

12. Exploitative and high-risk content

1. You may not create, request, publish, or share child sexual abuse material, sexual exploitation, sexual content involving minors, non-consensual intimate content, sexual blackmail, or content that violates law or policy.
2. We may restrict features by country, state, region, age, verification status, payment method, account history, or safety risk where reasonably necessary for legal compliance, safety, rights protection, fraud prevention, or policy enforcement.
3. You may not attempt to bypass eligibility controls, regional restrictions, filters, or safety controls.

13. Prohibited conduct

You may not:

1. violate law or third-party rights;
2. impersonate another person or misrepresent AI Output as a real person’s statement;
3. scrape, harvest, crawl, or bulk-export the Service without permission;
4. use the Service or AI Output to build, train, evaluate, or improve a competing AI model or service;
5. reverse engineer, interfere with, overload, attack, or bypass the Service;
6. create or distribute malware, spam, scams, phishing, or deceptive content;
7. exploit, harass, stalk, dox, threaten, or sexually exploit another person;
8. attempt to obtain another user’s private chats, personal information, credentials, or payment information;
9. publish content that includes someone else’s private, confidential, or sensitive information without authority; or
10. use the Service for high-risk systems, emergency response, professional advice, or unlawful decision-making.

14. Moderation, reports, and no general monitoring duty

We may provide reporting, blocking, filtering, content review, account review, appeals, and enforcement tools. We do not undertake a general obligation to monitor all content or conversations.

We may review User Content, AI Output, metadata, account information, payment records, and logs where we reasonably believe review is needed for support, safety, abuse prevention, legal compliance, dispute handling, chargeback handling, policy enforcement, security, bug investigation, or protection of users, third parties, or Pekochat.

We may remove, restrict, demote, label, block, preserve, report, or refuse to display content. We may suspend or terminate accounts. We may act without notice where urgent or legally required.

15. Peko and paid services

1. Peko is a virtual credit usable only within Pekochat. Peko has no cash value, is not money, is not a deposit, is not a stored-value account, and may not be sold, transferred, redeemed for cash, or used outside Pekochat unless we expressly allow it.
2. Paid Peko, promotional Peko, bonus Peko, and migrated Peko may have different rules. Promotional or bonus Peko may expire or be revoked.
3. The purchase screen or applicable paid-service terms will state the expiration, consumption, and refund rules for paid Peko. Mandatory laws governing prepaid access, gift certificates, virtual credits, unclaimed property, or consumer refunds remain unaffected.
4. Prices, packages, exchange rates, features, and consumption rules may change. Already-purchased paid Peko will be handled according to the displayed purchase terms and applicable law.
5. Refunds are provided only as required by law, payment processor rules, or our displayed refund policy. Peko consumed through AI processing, content access, or other completed digital services is normally not refundable unless required by law or caused by Pekochat’s material error.
6. We may reverse Peko, suspend accounts, or deny refunds for fraud, chargebacks, payment disputes, abuse, policy violations, or unauthorized transactions.

16. Subscriptions and auto-renewal, if offered

If Pekochat offers subscriptions, memberships, free trials, or auto-renewing plans, the purchase screen will disclose material terms, price, renewal period, cancellation method, and billing date before purchase. You authorize recurring charges until cancellation. You must cancel before the renewal date to avoid the next charge. State-specific auto-renewal rights remain unaffected.

17. Third-party services

The Service may use or link to third-party AI providers, payment processors, identity or eligibility-verification providers, hosting providers, storage providers, analytics tools, customer support tools, app stores, or external links. We are not responsible for third-party services outside our control.

18. Intellectual property of Pekochat

Pekochat and its software, interfaces, models, prompts, databases, design, trademarks, logos, ranking systems, recommendation systems, and platform materials are owned by Pekochat or its licensors. We grant you a limited, revocable, non-transferable, non-sublicensable license to use the Service for personal, lawful use under these Terms.

19. Copyright complaints and DMCA

If you believe content on Pekochat infringes your copyright, send a DMCA notice to our designated agent:

Your notice must include the information required by 17 U.S.C. § 512. We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate. If your content was removed and you believe it was removed by mistake, you may submit a counter-notification as permitted by law.

20. Privacy

Our Privacy Notice explains how we process personal information. By using Pekochat, you acknowledge that you have read the Privacy Notice.

21. Disclaimers

To the maximum extent permitted by law, Pekochat is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and error-free operation.

We do not guarantee that AI Output will be safe, accurate, unique, lawful, non-infringing, suitable, or appropriate. We do not guarantee that moderation, eligibility controls, filters, safety features, or reporting tools will detect or prevent all violations or harms.

Some states do not allow certain disclaimers, so some disclaimers may not apply to you.

22. Limitation of liability

To the maximum extent permitted by law, Pekochat, its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, exemplary, lost-profit, lost-data, business-interruption, emotional-distress, or reputational damages.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to Pekochat for the Service in the three months before the event giving rise to the claim; or (b) USD $100.

This section does not limit liability that cannot legally be limited.

23. Indemnity

You will defend, indemnify, and hold harmless Pekochat and its affiliates, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your User Content, Public Content, Shared Conversations, AI Output you publish or use, violation of these Terms, violation of law, infringement of rights, fraud, or misuse of the Service.

24. Termination

You may stop using the Service at any time and may delete your account through available tools or by contacting us. We may suspend or terminate your access for violation of these Terms, legal risk, abuse, security risk, payment disputes, or discontinuation of the Service.

Deletion effects are described in the Privacy Notice and relevant content sections. Some records may be retained for legal, security, accounting, fraud-prevention, backup, enforcement, or dispute purposes.

25. Governing law and arbitration

These Terms are governed by the laws of Republic of Korea, excluding conflict-of-law rules, except that federal law governs arbitration where applicable.

Informal resolution

Before filing a claim, you and Pekochat agree to try to resolve the dispute informally by sending written notice to [email protected] and allowing 30 days for response.

Arbitration and class waiver

Except for small claims, intellectual-property enforcement, or claims that cannot be arbitrated by law, you and Pekochat agree to resolve disputes through binding individual arbitration administered by AAA under applicable consumer arbitration rules. You and Pekochat waive jury trial and class, collective, consolidated, and representative proceedings to the maximum extent permitted by law.

You may opt out of arbitration within 30 days after accepting these Terms by emailing [email protected] with your account email and a statement that you opt out of arbitration.

If this arbitration section is found unenforceable for a claim, that claim may proceed in court, and the rest of these Terms remain in effect.

26. Changes to these Terms

We may update these Terms. Material changes will be posted or otherwise notified. If required by law, we will seek consent. Continued use after the effective date means you accept the updated Terms.
